- Moisture-sensitive thin-set is required for all white marble, limestone, and Cement products to prevent water stains or bleeding. The water used must be clean. Premium white thin-set is recommended.
- Before installation, it is essential to open all the boxes and dry lay all the material for blending, seeking customer approval.
- It’s prudent to order extra material to account for waste, cuts, and material selection, with a recommendation of at least 10% for regular cuts and potentially up to 30% for diagonal cuts.
- Keep in mind that natural stone exhibits variations in color, veining, and character. Samples only provide a general idea of the quarry’s characteristics, and there will be variances from one shipment to another and within each shipment.
- If your project involves more than one crate, it’s your responsibility to ensure proper blending to meet your client’s expectations.
- When ordering additional material, it’s vital to confirm that it matches the current lot.
- Grout release or sealer should be applied before grouting.
- To prevent expansion and contraction, a minimum of 1/8” joint is recommended for all installations.
- Please be aware that natural stone, being a product of nature, may contain minor imperfections, pits, holes, fill, etc. These are considered inherent characteristics of natural stone.
NO WARRANTY OF COLOR
Arabica Tile Group (ATG) offers natural and handmade products, where shade and color variations are inherent. ATG does not assume any liability for differences in shade and/or color between received tiles and sample tiles.
ACCEPTANCE
Any concerns regarding tile color, design, or quality must be addressed before placing order. The act of place order signifies acceptance, and no adjustments or returns will be considered afterward. Any questions regarding acceptability must be resolved within 30 days from the date of delivery.
NO WARRANTY AS TO QUANTITY ESTIMATES
Arabica Tile Group (ATG) will not be held responsible for any damages arising from tile shortages or overages. Buyers are responsible for determining the quantity of tiles needed, including matching additional lots.
AVAILABILITY
The availability of all items sold by Arabica Tile Group (ATG) is subject to the time of shipping. In cases of unavailability, ATG reserves the right to offer an alternative material with prior notice to the buyer.
TERMS: PAYMENT
Prices may change without prior notice. Unit prices and extensions will be confirmed and corrected by the main office, and customers will be informed of any changes or corrections before order processing.
EXCLUSION OF DAMAGES
Arabica Tile Group (ATG) shall not be liable for any consequential, incidental, indirect, exemplary, or special damages, whether in contract or in tort, in any action, in connection with any goods provided by ATG. ATG makes no warranties regarding merchantability or fitness for a particular purpose.
NORMAL WEAR; GROUT
Like all tile surfaces, some wear, crazing, or scratching may occur over time with use. Additionally, ATG recommends using matching colored or uncolored grout and applying grout release before grouting.
SPECIAL OR CUSTOM ORDER
A 50% deposit is required before placing a special order, with the balance due before shipment. Special orders cannot be canceled or returned.
DELIVERY TERMS
Prices are F.O.B. our warehouses, and Arabica Tile Group (ATG) is not responsible for shipping-related damages. Any claims for damage must be submitted in writing to the carrier with a copy to ATG within 5 days of receiving the merchandise. It is your responsibility to arrange unloading with the carrier, and we are not liable for damages due to detention charges. Our carriers do not provide inside delivery, and it is your responsibility to safely unload and store materials.
SAMPLE SHIPMENTS
Sample shipment charges are for single samples only. Ordering more than 2 samples of the same item may incur packing charges.
We do not assume responsibility for tiles damaged during shipping.
FORCE MAJEURE
Arabica Tile Group (ATG) will not be held liable for delays in delivery or other performance-related issues due to factors beyond its control, including acts of God or government, labor disputes, or difficulties in securing materials, labor, or transportation. In such cases, the time for delivery or performance by ATG will be extended for a duration equal to the delay.
ASSIGNMENT
This agreement cannot be assigned by the purchaser without prior written consent from Arabica Tile Group (ATG). Any attempt to assign rights, duties, or obligations without written consent from ATG will be considered void.
CONFLICT OF TERMS
This agreement is based on the terms, conditions, and warranties provided herein. In the event of any conflict, these terms and conditions take precedence over those on the buyer’s order form. Any agreement to alter, modify, or extend the terms of this agreement is valid only if it is in writing and duly signed by the parties involved.
